If I Simply Intend to Plead Guilty, Why Do I Need a Lawyer?

Been charged with a crime? The situation is stressful for sure. Most people just want the whole situation to go away. Thus, it is quite common for criminal defendants to accept a plea bargain. These deals amount to a win-win situation for almost all involved; however, this comes with some very important caveats.

The Benefits of Pleading Guilty

First, the prosecution wins out because they fulfill their professional duty to prove the defendant guilty. Furthermore, trials cost a lot and take time. For pleading guilty, you receive a much lighter sentence as a result.

The Downsides and Why You Need a Lawyer

Many people talk to the police, trying to be friendly. In the end, the authorities develop a solid case against them. Any lawyer will tell you that your statements can be contorted to seem like an admission. For example, you claim you are sorry. Seems harmless, until presented in a hearing before a judge. Then, that simple statement seems an admission of guilt. The punishment will increase in severity even if you plead guilty!

Also, remember that a guilty plea should be negotiated. Every settlement is not the same. For example, a lawyer can request a sealed record. After you complete your sentence the record will be virtually non-existent as long as you stay clean.

Last, but not least, always remember that a guilty plea may be only for a certain crime. A lawyer needs to be there to ensure that the plea includes any related charges. Too many defendants plead guilty on certain counts, then get re-arrested for other crimes admitted to during police interviews. These related crimes could have been included in the negotiations, precluding another arrest.
